Data and Privacy in the Workplace

The extensive data that most organisations process in relation to there staff, coupled with the increasing awareness of rights have brought data and privacy issues in the workplace have given a new level of significance for HR and legal departments. We help organizations manage rapidly evolving HR data privacy issues and mitigate the risk of litigation or regulatory sanction.

 

Our data protection advisory work is led by Chris Tutton. Chris is CIPP/E qualified and a member of the International Association of Privacy Professionals (IAPP) the world’s largest information privacy organisation.

We have expertise in handling the full range of HR data and privacy issues, and particular experience in the following areas:

  • Advising on data subject access requests in the context of the workplace, together with the application of the other data subject rights, such as the right to be forgotten.

  • Litigating breaches of the Data Protection Act 2018 in the Civil Courts and advising on issues relating to complaints to the ICO.

  • Advising on privacy issues such as monitoring and background checking and recruitment in the workplace.

  • Drafting and advising on legitimate interest assessments and privacy impact assessments in accordance with ICO guidance.

  • Drafting policies and procedures which are compliant with the GDPR and ICO guidance

  • Drafting and negotiating data protection provisions, such as processor-to-controller clauses, in workplace contractual documents.
