Grievances

Complex grievances can be hugely burdensome for organisations, draining time and resources, and in some cases leading to litigation. Robust policies and procedures are a must, but beyond this, having strategic advice on how to manage the various competing issues and priorities from an experienced adviser, can have a very positive impact on outcomes.

Our advisory work routinely sees us provide strategic guidance on how to effectively manage grievances, for example:

  • Distilling the key legal issues, and how to address them.

  • Navigating the pitfalls inherent in multi-party complaints, such as investigations and interviews, suspensions and conducting formal hearings.

  • Advising on when and how to conduct settlement negotiations to achieve a desirable outcome.

  • Advising on potential regulatory implications of the complaint.

  • Thinking laterally and finding alternative resolutions to complaints.

  • Mitigating the risk of litigation arising out of a grievance, and uplifts in compensation for failures to comply with the ACAS Code of Practice.
