New corporate offence: failure to prevent fraud

On 1 September 2025, a new corporate criminal offence of failing to prevent fraud came into force under the ECCTA legislation. Employers will be liable to this offence if any of their employees or other “associated persons” commits a fraud intending to benefit the employer.
